Terms of Use

These Terms of Use ("Terms") govern your access to and use of the SAW Ops website (sawops.com), operations portal (portal.sawops.com), 90-day pilot program, and any associated services, software, connected device networks, or hardware operated or provided by SAW Ops, Inc. ("SAW Ops," "we," "us," or "our"). By accessing or using our services, you agree to these Terms.
1. Acceptance of Terms
By accessing sawops.com, portal.sawops.com, or participating in any SAW Ops pilot program or deployment, you represent that you have read, understood, and agree to be bound by these Terms. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
SAW Ops provides a proximity-based worker safety and operational awareness platform consisting of:
- Worker-worn alert devices and equipment, vehicle, static, and portable site beacons
- LTE cloud connectivity for near real-time geofence evaluation and proximity alert processing
- Configurable alert ranges, escalating proximity logic, and acknowledgment controls
- The SAW Ops Operations Portal for device management, zone configuration, and analytics
- Optional AI-supported operational analytics and reporting
- 90-day structured pilot programs for worksite evaluation and system validation
SAW Ops is a supplemental safety awareness tool designed to add a real-time detection layer on top of existing safety programs. It does not replace legally required safety procedures, PPE, supervisors, cameras, radios, or training.
3. Safety Disclaimer
IMPORTANT: SAW Ops proximity alert technology is designed to supplement — not replace — existing workplace safety programs, procedures, and regulations. SAW Ops does not guarantee the prevention of all workplace accidents or injuries. System performance depends on proper device maintenance, LTE connectivity, battery status, beacon placement, and operational readiness. Organizations deploying SAW Ops remain solely responsible for:
- Compliance with all applicable occupational health and safety laws and regulations
- Maintaining all required safety personnel, procedures, PPE, and equipment
- Ensuring proper device charging, maintenance, and operational readiness
- Training workers on device operation, alert acknowledgment, and system limitations
- Responding appropriately to all SAW Ops alerts and warnings
4. 90-Day Pilot Program Terms
Pilot program participants agree to the following additional terms:
- Pilot scope, device quantities, zone configurations, and deployment schedule will be defined in a separate Pilot Agreement executed prior to deployment
- Client organizations are responsible for designating a site contact and facilitating device distribution and worker orientation
- SAW Ops retains ownership of all hardware devices and beacons deployed during the pilot period
- All devices must be returned in good working condition upon pilot conclusion unless a purchase or extended deployment agreement is executed
- Operational and safety data collected during the pilot will be used to generate the Safety & Operations Report delivered at pilot conclusion
- Pilot data is subject to the SAW Ops Privacy Policy and Data Firewall structure
5. Portal Account Terms
To access portal.sawops.com, you must create an authorized account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify SAW Ops immediately of any unauthorized account access
- Use the portal only for authorized worksite safety management purposes
- Not share account credentials with unauthorized personnel
6. Acceptable Use
You agree not to use SAW Ops services to:
- Conduct unlawful individual worker surveillance in violation of applicable privacy laws
- Attempt to access, tamper with, or reverse-engineer device firmware or portal systems
- Interfere with LTE connectivity, network operations, or system availability
- Use location or proximity data for any purpose other than worksite safety management
- Misrepresent deployment data in safety documentation, insurance filings, or regulatory submissions
7. Intellectual Property
All software, algorithms, firmware, designs, documentation, and content comprising the SAW Ops platform are owned by SAW Ops, Inc. and its licensors. These Terms do not grant you any rights to SAW Ops intellectual property beyond the limited license to use the platform as described herein.
8. Data and Privacy
Your use of SAW Ops is subject to our Privacy Policy, which is incorporated into these Terms by reference. SAW Ops does not provide employers with individual worker location histories. All device-level data is governed by the SAW Ops Data Firewall structure described in the Privacy Policy.
9. Hardware and Device Terms
Where SAW Ops provides hardware devices as part of a pilot or deployment:
- Devices remain the property of SAW Ops unless a purchase agreement is executed
- Client is responsible for reasonable care of devices while in their possession
- Lost, stolen, or damaged devices beyond normal wear may be subject to replacement charges
- Devices must not be modified, disassembled, or used outside of their intended purpose
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAW OPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING ANY WORKPLACE INCIDENT OCCURRING DURING A SAW OPS DEPLOYMENT. SAW OPS'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold SAW Ops, Inc. harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or any workplace incident occurring at your facility.
12. Modifications to Service and Terms
SAW Ops reserves the right to modify these Terms or the platform at any time. We will provide reasonable notice of material changes to active customers. Continued use of the platform after notification constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
